Notiz, Universität Bielefeld (FB Rechtswissenschaften), Sprache: Deutsch, Abstract: Durch das Gesetz zur Änderung des AGBG vom 19.06.19961 wurde die EG-Richtlinie über mißbräuchliche Klauseln in Verbraucherverträgen vom 05.04.19932 in nationales Recht umgesetzt. Zunächst wurde die Inhaltskontrolle bei Verbraucherverträgen in § 24a AGBG geregelt. Durch das Schuldrechtsmodernisierungsgesetz wurde diese Vorschrift in § 310 III überführt.

Verbraucherverträge sind Verträge zwischen einem Unternehmer und einem Verbraucher (§§ 310 III, 13, 14 I ). Die Vertragsbedingungen gelten hierbei als vom Unternehmer gestellt, sofern sie nicht vom Verbraucher in den Vertrag eingeführt worden sind (§ 310 III Nr. 1). Abweichend von § 305 I 1 sind wesentliche Teile der §§ 305 ff sowie Art. 29a EGBGB auch auf vorformulierte Vertragsbedingungen in Individualverträgen anzuwenden, wenn diese nur zur einmaligen Verwendung bestimmt sind und soweit der Verbraucher wegen einer Vorformulierung auf ihren Inhalt keinen Einfluß nehmen konnte (§ 310 III Nr. 2). Eine unangemessene Benachteiligung i. S. d. § 307 I, II kann sich auch aus den Begleitumständen des Vertragsabschlusses ergeben (§ 310 III Nr. 3).

Umstritten ist, in welchem Umfang § 310 III bzw. § 24a AGBG zu einer gegenüber der bisherigen Rechtslage weitergehenden Inhaltskontrolle notarieller Verträge geführt hat.

Diese Möglichkeit wurde anfangs nach einer Ansicht als „Diskriminierung eines ganzen Berufsstandes“3 abgelehnt, während es sich nach anderer Auffassung um eine „nicht unwesentliche Veränderung der Stellung des Notars“4 handelt oder „keine Schwächung der Stellung der Notare“5 vorliegt.
