Die Nachteile von einem Zivilprozess liegen in der Überlastung der Gerichte begründeten langen Verfahrensdauer und den nicht unerheblichen Gerichts- und Anwaltskosten. Der schwerwiegendste Nachteil ist jedoch, dass in einem Gerichtsverfahren Rivalität zwischen den Parteien herrscht bzw. aufgebaut wird und das Urteil zumindest bei der unterliegenden Partei Unmut hervorruft. So wird eine Partei mit dem Urteil immer unzufrieden sein, bzw. sogar beide bei einem Teilobsiegen. Dies führt zu einer Störung des Verhältnisses der Parteien und sorgt oft dafür, dass sie keinen Raum für zukünftige Beziehungen mehr sehen. Als Reaktion auf diese Problemfelder wurde die Mediation ins Leben gerufen. Diese im angloamerikanischen Raum schon sehr verbreitete Form der alternativen Streitbeilegung erfreut sich seit einiger Zeit auch
in der Bundesrepublik Deutschland immer größerer Beliebtheit. Sie zielt darauf ab, dass die Parteien gemeinsam eine für beide zufrieden stellende Lösung selbst erarbeiten um somit auch von einer Fortführung der Beziehung in der Zukunft profitieren zu können. Weiterhin zeichnet sich ein Mediationsverfahren durch eine vergleichsweise kurze Verfahrensdauer und vergleichsweise geringe Kosten aus. Bei all diesen Vorteilen des Mediationsverfahrens dürfen die Problemfelder nicht außer Acht gelassen werden. So fehlte es in der Vergangenheit an Verfahrensstandards bzw. gesetzlichen Grundlagen, so dass es diesbezüglich zu Unsicherheiten kommen konnte. Die Mediation war daher eine mögliche Alternative zum Gerichtsverfahren, aber kein integrierter Bestandteil des Justizwesens. So war eine Mediationsvereinbarung z.B. abgesehen von einer Titulierung durch
den Notar oder in Form eines Anwaltsvergleiches nicht vollstreckbar. Dies hat sich in diesem Jahr dadurch geändert, dass das Europäische Parlament und der Rat der Europäischen Union am 21.05.2008 die Richtlinie über bestimmte Aspekte der Mediation in Zivil- und Handelssachen (Mediationsrichtlinie) erlassen haben. Diese Richtlinie ist seit dem 13.06.2008 in Kraft und die Bundesrepublik hat ab diesem Tag drei Jahre Zeit sie in nationales Recht umzusetzen. Die Arbeit gibt einen Überblick über die Richtlinie, ihren Hintergrund und ihre Entwicklung und stellt ihre Kernpunkte darstellen.
