Der Streit um die generelle Zulässigkeit von Sterbehilfe ist ein solches Thema. Dabei ist die Kontroverse nicht speziell ein Phänomen unserer Zeit, auch wenn durch immer neuere medizinische Erkennt-nisse und Fortschritte das Problem teils noch verschärft wird, sondern beschäftigte bereits die Menschheit in der Antike. Weitere Brisanz erhält die Auseinandersetzung in Deutschland durch die Erfahrungen aus der Zeit des Nationalsozialismus und deren menschenverachtenden Eugenik-Programmen unter dem Deckmantel der Euthanasie. Dass die Einführung gesetzlicher Regelungen nicht zwangsläufig ein Tabu darstellt, zeigt sich in unseren Nachbarländern Belgien und den Niederlanden. Beide Staaten haben unlängst die Anwendung aktiver Sterbehilfe durch entsprechende Gesetze legalisiert. Es stellt sich demnach die Frage, ob und inwieweit eine solche Gesetzgebung mit dem unsrigen Menschenbild und unseren Werten vereinbar ist.
Aufgabe dieser Arbeit wird hierbei sein, die von manchen Wissenschaftlern und Teilen der Gesellschaft geforderte Einführung der aktiven Sterbehilfe in Deutschland im Hinblick auf die Verfassung und ihrer Grundrechtsgewährleistungen zu untersuchen. Schwerpunkte der Prüfung werden dabei die Würde des Menschen und das Recht auf Leben sein, welche beide Höchstwerte unserer Gesellschaft sind. Es sollen die Fragen beantwortet werden, ob die Situation de lege lata mit der Verfassung vereinbar ist und ob die Pflicht oder die Möglichkeit für den Gesetzgeber besteht, die aktive Sterbehilfe de lege ferenda zuzulassen.
